Corporate Manslaughter Legislation – Investigating Collisions

The Corporate Manslaughter Legislation requires business owners to required to manage the risks their employees are exposed to.  Part of these requirements is the need to investigate all at-work accidents, this will include at-work road accidents.

These are a key factor in the way you manage and develop your risk strategy.  We are not interested in blame, that is the realm of insurance companies and personal injury lawyers; you are only interested in the cause not the fault.

Your accident statistics will tell you the information you need to know on:

Who

When

Where

What

You then need to find out the most important piece of information – WHY!

The collation of accident data is simple to do, but why do it yourself?  An accident management company will take the drivers initial call from the scene, manage the any third parties, repair your vehicle, repair the third party vehicle, keep your driver on the road, report the event to you, handle the uninsured loss recovery and compile all this information into an easy to follow report.  They can also live notify you and your Enforcement Liaison Team by email as the driver reports in.
And the best bit about all of that work being done by the accident management company?  It is FREE of charge to you the fleet manager or business owner.

Once you have the data you need to analyze it to find out the why.  To understand why your driver had the collision you need to ask the right questions and then decide whether you have been given the correct answers.  Getting the right information is essential to ensure that you make the best use of that information.  Your data will also identify your collision prone drivers and may also show you whether some of your vehicle are crashing more often than similar types of vehicles.

Based on all the information you have you can decide whether you need to consider driver training or review the vehicles you are purchasing or leasing.

We shall cover the company investigative procedure in more detail in another article soon as it differs slightly form the Police investigative model.
