Corporate Manslaughter Legislation – The first prosecution
Towards the end of last week the press started to report the first company to be prosecuted under the 2007 Corporate Manslaughter Act. I am slightly surprised that it has taken this long for a prosecution to be made and but not so surprised that it is not a vehicle relate prosecution.
Clearly in the ongoing case the CPS feels that the management of systems at the business concerned were below the standard expected, but how many other companies are in a similar position? More worrying still is that most businesses are unwittingly taking huge chances with their profit margins and the liberty of the senior management.
